Terms and Conditions of use of the Tower of David Museum of the History of Jerusalem’s Site

Please read the Terms carefully before using the Site.

  1. General
    1.1. The following Terms apply to the Site operated by the Tower of David Museum of the History of Jerusalem Association at http://a3806-tmp.s85.upress.link/ RA 58-001673-1 (hereinafter: the “Site” and the “Museum”).
    1.2. The Terms apply to use of the Site using any computer or other communication device including a smart phone, etc., and any content contained therein, including but not limited to data of any kind including all verbal, visual, audio, and audiovisual data, documents, images, photographs, illustrations, software, files, computer codes, applications, and databases (hereinafter: the “Content”).
    1.3. These Terms are in addition to all other terms and conditions contained in the Site and in the case of any discrepancy, the provisions of these specific Terms and conditions shall prevail.
    1.4. The Site user understands that the use of certain services on the Site is limited to users who are entitled to perform actions that are legally binding. If the Site user is a minor (under the age of 18) or is not entitled to perform legal actions without the consent of a guardian to use the Site including the Content and/or services and/or products it contains, the aforementioned user will be considered to have received the approval of his legal guardian to do so.
    1.5. The Terms are formulated in the masculine for convenience only yet refer to both genders.
    1.6. The headings in the Terms are intended only to make it easier to read and navigate the Terms and are not to be used to interpret the Terms.
  2. Use of the Site
    2.1. The Site as a whole, including all of the Content contained therein and the operating software, is provided to the user “as is”.
    2.2. The user accepts and is aware that access to parts of the site may depend on and/or be influenced by the installation of software components on his computer, including some browsers and extensions to these browsers. The user is responsible for determining and installing any software component required to use the Site at his own expense and responsibility. The Museum is not responsible for such software components or any defect in them that may result from their installation or non-installation. Without derogating from the above, access to the Site and the Contents on it may vary depending on the features of the hardware, operating system, or software on the user’s computer as well as their settings. The Museum does not guarantee that the Content will be shown in an identical and/or proper manner on different computers.
    2.3. The Museum may at any time make changes to the Site, remove Content from the Site, or add Content to the Site from time to time by updating the Site and it may also suspend and resume activity on the Site. The Museum is under no obligation to save the information and Content on the Site and is permitted to delete it.
    2.4. Links to other websites that are not operated by the Museum (hereinafter: “Links”) may appear on the Site. These Links are presented for user convenience only and the Museum has no control over such sites nor is the Museum responsible for their content. The Museum is not responsible for the content of such Links and cannot guarantee their proper functioning. The Museum may at its sole discretion remove any Link from the Site and/or add other Links.
    2.5. Third-party advertisements may appear on the Site. The Museum shall not be liable for the content of advertisements posted on the Site or the products or services they are advertising. Responsibility for such publications lies solely with the advertisers. Furthermore, the Museum is not responsible for the content of advertisements on the Site or for their reliability. It should be emphasized that the publication of commercial information does not of itself constitute any encouragement or recommendation to purchase services or products provided for sale on the Site.
    2.6. The museum may restrict user access to the Site or part of it and/or restrict access to the Site to users who have confirmed that they agree to certain special conditions.
  3. Copyright
    3.1. The Site as a whole and the Contents displayed on it include Contents that are the exclusive property of the Museum and/or third parties that have permitted the Museum to use them, and are protected by the laws of the State of Israel, international conventions, and foreign law governing the use of such Contents.
    3.2. The user must abide by the aforementioned laws and is banned from making any illegal use of Content, including commercial use, publication, distribution, copying, reproduction, creation of derivative works, processing or transfer, sale or lease of Content on the Site without the prior written consent of the Museum.
    Furthermore, the user is forbidden to use the names and trademarks displayed on the Site without the prior written consent of the Museum. Such approval may be given by the Museum after examining each request on its own merits and at the sole discretion of the Museum, which may place various conditions on its consent and demand user fees at its own discretion.
  4. User Liability
    4.1. The user shall not perform actions on the Site in contravention of any law and/or these Terms, including any commercial use of the Site’s Content or any part thereof and/or any intervention in the Content displayed on the Site including but not limited to altering or deleting data or Content, or actions that may limit or prevent others from using the Site.
    4.2. The user shall not perform any actions on the Site that constitute forgery, impersonation, misrepresentation, or fraud.
    4.3. The user shall indemnify and compensate the Museum for any direct or indirect damage and/or any expense incurred by the Museum in connection with a claim and/or any suit arising from use of the Site, including any action contrary to these Terms or the provisions of any law.
    4.4. Without prejudicing any other rights of the Museum, the user accepts that in cases where the Museum suspects that the user has used the Site in a way that is inconsistent with the provisions of these Terms and/or any law, the Museum shall be entitled to take any action, as it deems fit, to protect its rights and/or the rights of third parties and inter alia to prevent the user from accessing the Site and to record and/or monitor the user’s use of the Site.
    4.5. It is also hereby clarified that the Museum may convey information about the user’s identity and the user’s actions on the Site to third parties if required to do so by law or if it faces a threat of legal proceedings (criminal or civil) for acts committed by the user on the Association’s Site. In such a case, the Museum may provide information about the user to the party claiming to have been harmed by the user or subject to a judicial order.
  5. Warranty Disclaimer
    5.1. Use of the Site is at the user’s own risk.
    5.2. The Museum and/or third parties are in no way responsible for use of the Content on the Site, including the accuracy, reliability, availability, and quality of the Site Content, and bear no responsibility or liability for any disruption, errors, or omissions in the Content published on the Site.
    5.3. The Museum is not responsible for any direct, indirect, consequential, or incidental damage resulting from accessing and using the Site or resulting from any restriction of use of the Site, whether due to contractual or tortious causes. The Museum is not responsible for any damage including damage resulting from a virus or malware such as Trojan Horse, Worms, or various software applications on the user’s computer or any other property as a result of browsing or using the Site, including downloading information and/or Content from the Site.
    5.4. The Museum uses data-protection systems and procedures on the Site. Although these systems and procedures reduce the risk of unauthorized access to the Museum’s computers, they cannot provide absolute security. Therefore, the Museum does not guarantee that the services on its Site are completely immune from unauthorized access to the data stored in it.
    5.5. The Museum and third party advertisers on its Site use “cookies” to ensure the Site’s proper daily functioning, including collecting statistical data about Site use, verifying information, adjusting the Site to the user’s personal preferences, for the purposes of security, and to obviate the need to enter your details in designated areas of the Site.
    If you do not wish to receive “cookies,” you can prevent this by changing the settings in your browser. To do so, please refer to “Help” in your browser. You can also delete the “cookies” from your computer at any time.
  6. Various Provisions
    6.1. The Museum may assign its rights and obligations under these Terms or any part thereof.
    6.2. The Museum reserves the right to make changes to these Terms at any time, at its own discretion and without notice. Any changes to the Terms will take immediate effect on being posted in the Site’s Terms of Use. It is the user’s responsibility to check and remain updated on the Terms of Use.
    6.3. Use of data and Content that is not in accordance with these Terms of Use shall constitute grounds for taking any and every legal measure available to the Museum.
    6.4. All activity on the Site and everything related to and connected with it, including the Terms of Use, are subject exclusively to Israeli law, and jurisdiction over any dispute relating to the Site and its use and Terms of Use is subject exclusively to the competent Jerusalem District Court.

  7. Cancellations
    7.1 Tickets purchased online can be cancelled up to 5 days before the event by calling the reservation center at *2884 or at [email protected]
